Meeting Minutes

Mr. Rollinson, Vice-Chairman, called the meeting to order at 7:30 p.m. A quorum was present. Mr. Rollinson noted that the Minutes of the October 25, 2005 meeting were mailed prior to tonight’s meeting and there being no additions, corrections, or deletions, the Minutes stand approved as mailed.

1. Rezoning Request – Sandy Lake Borough - Mr. Dash explained that he received a request to rezone approximately 42.5 acres along Lake Street (SR 358), the southern side of Broad Street, School Street, Walnut Street, and the western side of Market Street from Residential (R-1) and Industrial (I) to Residential (R-2) District. He noted that the existing land use consists of ball fields, forestry, wetlands and open space. He stated that no rezonings have occurred in this area. The properties are accessed by Lake Street (SR 358), a minor arterial with 2,700 ADT, and by Broad, Walnut, Market, and School Streets, all Borough streets. The area has a gentle slope down towards the wetlands in the center of the area proposed for rezoning. The surrounding zoning and land uses to the north is all Residential (R-1), Single-Family residences on 1+ acre; to the south is all Industrial (I), industrial buildings are closer to Walnut Street along Lake Street, a quarry and forest; to the west is Residential (R-1) and Industrial (I), a meat market on the corner of Broad and Lake, and forest; and to the east is Central Commercial (C) and assorted residential and commercial uses. Public sewers exist along the current Borough streets, and would be able to serve any development within this area. Sandy Lake Borough has sent a letter stating that this area could service up to twenty (20) tap-ins. He next reviewed the 5 zoning amendment review criteria and stated that the only possible conflict would be with the industrial zoning district to the south, and surrounding the area that is proposed to be rezoned on the south side of Lake Street. Increased buffer areas would have to be provided for any further expansion or development in the industrial zone surrounding the area proposed for rezoning from "I" to "R-2". MCRPC staff would recommend approval of the proposed rezoning.

In discussion, Mr. McCandless asked about the industrial building on the north side of Route 358. Mr. Hogan thought there was a plant located in that building. Mr. Dash stated that he thinks the building is vacant. Mr. Dash stated that this rezoning is being requested to allow for residential development to occur in the area, which is not allowed in the Industrial zone, and not at the density that the applicant are seeking in the Residential (R-2) zone. Mr. McCandless asked who requested this change. Mr. Dash stated Brad Martin was the applicant who requested this change.

After discussion, a motion was made by Mr. Hogan to recommend approval of this rezoning request. Mr. McAdams seconded. In further discussion, Mr. McCandless questioned about other R-2 lands. Mr. Dash stated that the majority of the R-2 zoning district in the Borough has been built out, except for lands located well behind Borough streets and then there could be issues with slope and development constraints. There being no further discussion, the motion was approved.
