Meeting Minutes

Mr. Scott, Chairman, called the meeting to order at 7:27 p.m. A quorum was present. A motion was made by Mr. McCandless and seconded by Mr. Garrett to approve the Minutes of the September 16, 2003 meeting with no additions, corrections, or deletions. The motion passed.

N E W B U S I N E S S

1. Igor Pyatetsky Rezoning Request - Hermitage City – Mr. Dash explained a request to rezone property of Igor Pyatetsky (1.2 acres, situated between PA 18 North Hermitage Road and Valley View Road north of Lamor Road) from R-1-100 Single-Family Residential to R-3 Residential/Office. He also stated that this rezoning meets most of the five zoning amendment review criteria for map amendments.

In discussion, Mr. McCandless asked what a conversion dwelling was, which was listed as a permitted use under the R-3 district. Mr. Dash noted that there was not a definition in the Hermitage Zoning Ordinance, but Mr. Rollinson said he would check it out. Committee members had concerns about congestion/traffic at the Valley View/Lamor/N. Hermitage Road intersection by opening up Valley View Road to office use. Also, Committee members felt that this rezoning would open up further properties wanting to be rezoned. They also felt that the demand for office is not increasing in the area, and that there are adequate amounts of land available for development in the Institutional, Office Building, and Commercial districts in the City to fill the demand for office. It was also noted that the PA 18 North Corridor Study recommends a mixed-use district for this area, which the City is currently in the process of developing.

Mr. Scott asked if there was any further discussion. Mr. McCandless asked if the City of Hermitage had reviewed this rezoning request. Mr. Rollinson stated that the City would review this rezoning request at their December 8th meeting.

After discussion, a motion was made by Mr. Price and seconded by Mr. Garrett to recommend denial of the Rezoning Request. Mr. Scott asked if there was any further discussion or questions on the motion. There being none, a vote was taken: none in favor; 2 opposed; no position or recommendation. Mr. Scott discusses indecision. Mr. Garrett stated his concerns on the traffic congestion and felt that the demand for office is not increasing in the area. Mr. McCandless did not think that this rezoning would have adverse impact. Mr. Price stated that we are setting precedent up Valley View Road. Mr. Puko and Mr. Rollinson discussed the mixed-use district, which the City is currently in the process of developing. It was felt that when the mixed-use overlay district is completed, it would better suit the regulation and location of any office use in the area of the proposed rezoning than the R-3 district.

After further discussion, Mr. Garrett made a motion to recommend denial of the rezoning request (put rezoning off until the mixed-use district is passed, because the property will work better in that district, in addition to traffic concerns up Valley View Road to the Valley View/Lamor/N. Hermitage Road interchange. Mr. Price seconded. Mr. Scott clarifies the motion. The motion passed to deny the rezoning request. Mr. McCandless opposed.

There being no further business to conduct, the meeting adjourned at 8:17 p.m.
