Meeting Minutes

Mr. Sam Scott, Chairman, called the meeting to order at 7:30 p.m. A quorum was present. Mr. Scott noted that the Minutes of the September 28, 2004 meeting were mailed prior to tonight’s meeting and there being no additions, corrections, or deletions, the Minutes stand approved as mailed.

N E W B U S I N E S S

1. Final Plan - The Villas at Grove City – Pine & Liberty Townships – Mr. Dash explained the Final Plan approval for The Villas at Grove City. He noted that the application was filed on October 8th, which consists of 2 lots (136 condominium units). The property is located in the northwestern corner of Center Church and Schmidt Roads in Pine & Liberty Townships. All conditions of preliminary plan approval have been satisfied, which consisted of the maintenance agreement for the streets. Approval for the sewer line extensions in Pine & Liberty Townships have been given by DEP. Mr. John Nicklin, Pine Township Fire Chief, approved the spacing of the hydrants and the design of the development. Comments had been received by the Mercer County Conservation District. The engineer, Hampton Technical Associates, handled all the comments that were needed with storm water management to the Conservation District’s satisfaction. The paperwork regarding the financial guarantee for the installation of the remaining improvements have also been received.

In discussion, it was noted that everything that was needed for final plan approval has been satisfied. After discussion, a motion was made by Mr. Price and seconded by Mr. Rollinson to recommend approval of the Final Plan for The Villas at Grove City. The motion passed with Dr. Brenner abstaining.

2. Modification Request – Jeffrey & Susan Lumley – Pine Township – Mr. Dash explained the modification request for Jeffrey & Susan Lumley, which is located between East Pine Street Extension and Pinchalong Road in Pine Township. He noted that the approximate size of the property is 8.09 acres. The present zoning is R-2 Residential One-Family. The existing land use is Single-Family Residence and Woodlands. The Lumley’s are requesting a modification to the Mercer County Subdivision and Land Development Ordinance, Section 407 (2.f), the depth of a lot shall not exceed four times the width of the lot. The modification requested is to subdivide the existing house from woodlands behind the house, which are to be sold as a non-building lot to a neighboring property owner.

Mr. Dash stated that the owners are proposing to subdivide their property into two lots. Lot #8, which is 5.31 acres and is heavily wooded fronts on Pinchalong Road and would be sold as a non-building lot to a neighboring property owner. The Lumley’s are requesting a modification to the remainder of the lot, which is 2.78 acres (155’ x 783’), fronts on East Pine Street Extension and has a single-family dwelling on the property. The only alternative would be for the lot on East Pine Street Extension to be only 620’ deep instead of 783’, but this would create an odd configuration of lots, as the 783’ depth is the same as the neighboring lots that front on East Pine Street Extension.

In discussion, there was some question about neighboring properties. Mr. Dash clarified the neighboring lots to Committee members. He noted again that the 5.31 acres is heavily wooded and would be sold as a non-building lot to a neighboring property owner, which is not an adjoining lot. After further discussion by all, a motion was made by Mr. Garrett and seconded by Mr. Faull to recommend approval of the proposed modification. Committee members discussed getting rid of the 4:1 requirement. Mr. Dash explained the validity of our regulations and that some type of restriction should be in place. There being no further discussion, the motion passed.

3. Further Discussion – Mr. Dash explained that the Preliminary and Final Plan for Mallard Lake Plan of Lots in Pine Township and the modification request related to this plan have been tabled until next month.
