Mr. Sam Scott, Chairman,
called the meeting to order at 6:30 p.m. A quorum was present. Mr.
Scott noted that the Minutes of the August 17, 2004 meeting were mailed prior
to tonight’s meeting and there being no additions, corrections, or
deletions, the Minutes stand approved as mailed.

1. Zoning Ordinance Text
Amendment – City of Hermitage –
Mr. Dash explained that the City of Hermitage would like to amend Subsection
401.40 Non-Conforming Uses and Structures to allow more flexibility for
non-conforming uses to expand, not only in size, but also onto adjacent vacant
lands. He noted that the area that they are allowed to expand was increased
from 50% to 100%. He stated that such activities must meet the minimum yard
regulations and height restrictions of the district in which the structure is
located, and must meet all off-street parking and loading requirements of the
Ordinance.
In discussion, Mr. Rollinson
talked about the Hermitage Planning Commission. Mr. Hogan commented that you
cannot foresee what will happen in the next 20 years. Mr. Scott asked about
the buffer yard. It was clarified that expansion of non-conforming uses in any
zoning district shall provide a buffer yard in compliance with the Hermitage
Zoning Ordinance. Mr. McCandless asked if this change would affect any other
non-conforming business. Mr. Dash stated that it could affect any pre-existing
non-conforming business. Mr. Garrett asked about other instances in the City
besides Joy Cone Company. Mr. Dash stated that to the best of his knowledge,
there were none. Mr. McCandless asked if the Zoning Hearing Board would review
each request. Mr. Dash stated that any expansion of a non-conforming use would
be considered by the Zoning Hearing Board.
After discussion, a motion
was made by Mr. McCandless and seconded by Mr. McAdams to recommend approval
of the proposed text amendment. Mr. Rollinson objects to rezoning for
benefit of a singular business, but if it is for the betterment of the order. The
motion passed.

There being no further
business to conduct, the meeting adjourned at 6:45 p.m.
