Meeting Minutes

Tuesday – September 16, 2003 – 7:30 p.m. at the MCRPC Offices

Mr. Scott, Chairman, called the meeting to order at 7:30 p.m. A quorum was present. A motion was made by Mr. Rollinson and seconded by Mr. McCandless to approve the Minutes of the July 15, 2003 meeting with no additions, corrections, or deletions. The motion passed.

N E W B U S I N E S S

1. Tentative Plan for The Ledges of Pierce Bluffs Planned Residential Development (PRD) – Hermitage City – Mr. Dash explained that Mill Creek Enterprises, Inc., in the owner of the property and is located on the north side of Lamor Road between Thorn Road and Trout Island Road. The Tentative Plan for The Ledges of Pierce Bluffs Planned Residential Development would consist of 19 single-unit (detached) condominiums on 10.02 acres. The Hermitage Comprehensive Plan recommends low-density residential use for this area, and open space for the area in the proposed PRD that is reserved as communal open space. The development would be accessed through the existing single-family and condominium development, which enters/exists off Lamor Road. The subject property is zoned R-1-100, Residential Single-Family, and the surrounding zoning to the north, east, south and west is also zoned R-1-100 Residential Single-Family. The development would be serviced with public sanitary sewers and water, which would be extended from the existing development.

The Hermitage Planning Commission recommended approval of the Tentative Plan on August 4th, subject to a number of conditions set by the Hermitage Planning department. Mr. Dash noted that the developer would need to meet the following conditions: 1) add to their narrative statement how they are going to preserve natural features; 2) provide more information regarding the open space areas; 3) provide outdoor living area requirements; 4) provide pedestrian facilities such as sidewalks or trails; and 5) show the storm water management facilities on the plan.

In discussion, it was noted that this particular PRD would remain private, but would have to meet the requirements for streets by the Hermitage Planning Commission and the Hermitage Fire and Police Departments to address their concerns relative to emergency access. Also, Committee members were concerned about maintaining certain things through the Homeowners Association.

After discussion, a motion was made by Mr. McCandless and seconded by Mr. Faull to approve the Tentative Plan for the Planned Residential Development known as The Ledges of Pierce Bluffs, subject to the conditions set by the Hermitage Planning Commission. The motion passed.

2. Zoning Ordinance Text Amendment – Hermitage City – Mr. Dash noted that the City of Hermitage is proposing to add a second Planned Technical Park (PTP-2) zoning district, define "Corporate Office", and to correct an existing discrepancy in building height requirements. He explained that the reason for this amendment would be that the City is implementing a Tax Abatement Zone in part of the Lindenpointe Business Park, and the Hermitage Economic Development Commission recommended that the permitted uses in part of the park be changed, in the part that is the Tax Abatement Zone. Also, the maximum building height was changed from 30 to 45 feet in the Area Regulations section under the Planned Technical Park, to correct a discrepancy in building height requirements between two separate sections of the Zoning Ordinance.

In discussion, there were concerns on the addition of the second Planned Technical Park district. It was felt that the second PTP-2 district would be too similar to the existing Planned Technical Park district.

A motion was made by Mr. McCandless and seconded by Mr. McAdams to deny the proposed amendment, due to it being too similar to the existing Planned Technical Park District to justify a new zoning district. The motion passed with Mr. Rollinson abstaining.

3. Rezoning Request – Hermitage City – Mr. Dash explained that we received a request from the City of Hermitage to rezone part of the Planned Technical Park (PTP) to Planned Technical Park-2 (PTP-2) in the Lindenpointe Business Park.

In discussion, Committee members do not understand why the new zone would be needed. A motion was made by Mr. McCandless and seconded by Mr. McAdams to deny the proposed rezoning, because the Committee does not understand why the new zone would be needed. The motion passed.

There being no further business to conduct, the meeting adjourned at 8:31 p.m.
