Mr. Sam Scott, Chairman, called the meeting to order at 7:30 p.m. A quorum was present. Mr. Scott noted that the Minutes of the May 24, 2005 meeting were mailed prior to tonight’s meeting and there being no additions, corrections, or deletions, the Minutes stand approved as mailed.

N E W B U S I N E S S

1. Modification Request – Jackson Township – Mr. Dash explained that he received a modification request from Logan L. Rouse, buyer of the proposed adjoining land. The property is 0.67 acres located on McCurdy Road. The owners, Michael & Charyn Hamelly, are proposing to subdivide their property into two lots. Lot "A", which is 0.67 acres, will be a non-building lot to become an adjoiner to the lands of Logan L. Rouse. The total size of the new Rouse property would be 1.21 acres and would have a lot with a width of 149.3’ and a depth of 735.31’. Lot "A" is heavily wooded, and abuts an abandoned railroad right-of-way. The only alternative for the lot to meet the 4:1 would be for the combined lot to go back 597.2’ deep along the abandoned railroad right-of-way instead of 735.31’.

In discussion, Mr. Hughes asked about the historical nature of a modification. He questioned when we changed the terminology from variance to modification. Mr. Dash stated that it was probably 3-4 years ago. Mr. Dash stated that a variance usually pertains to zoning regulations. He did note that in the Mercer County Subdivision and Land Development Ordinance they note it as a modification. Mr. Hogan stated that when he was on the variance board for Jefferson Township, variances did not go on deeds, you would have to reapply. A motion was made by Mr. Hogan to recommend approval of the modification request. In discussion, Mr. Price stated that when the railroad right-of-ways were abandoned, in many cases they were reverted back to their original owners. Mr. McCandless seconded the motion. In further discussion, Mr. Garrett talked about this abandoned railroad and how they tried to put a trail in. Mr. Price discussed situations with other abandoned railroad right-of-ways. Mr. McCandless questioned if the railroad right-of-way would affect this property. Mr. Dash stated no. There being no further discussion, the motion on the floor passed.

2. Zoning Ordinance Text Amendment – City of Farrell - Mr. Dash explained that the City of Farrell is proposing to amend their zoning ordinance, Article II – District Regulations, changing zoning district reference 202.10 to 202.11, in the I-3 Special Industrial District, due to it being referenced incorrectly. There being no discussion, a motion was made by Mr. Garrett and seconded by Mr. McAdams to recommend approval of the proposed zoning text amendment. The motion passed.

3. Discussion on Mercer County Subdivision and Land Development Ordinance – Mr. Dash explained that he has been inquiring about holding 5-6 regional meetings around the County to inform citizens and get some feed back on the "Revised Mercer County Subdivision and Land Development Ordinance". Committee members thought it would be a good idea to hold some regional meetings. After discussing some central locations to hold these regional meetings, it was suggested that we try to hold them at Sandy Lake Borough Building, Greenville/Hempfield area, Lackawannock Township Building, Pine Township Building and possibly the Fairview Township area. Mr. Dash noted that he will inquire into making arrangements at these various locations. Also, he completed a process guide for municipalities to follow which would explain land developments. Committee members requested a copy of the process guide. Mr. Dash asked members if they had any discussion or questions on the "Revised Mercer County Subdivision and Land Development Ordinance". There being none, a motion was made by Mr. McCandless and seconded by Mr. Price to recommend approval of the "Revised Mercer County Subdivision and Land development Ordinance". The motion passed.

ADJOURNMENT

There being no further business to conduct, a motion was made by Mr. Garrett and seconded by Mr. Hughes to adjourn the meeting at 8:03 p.m.
