Meeting Minutes

Tuesday – May 16, 2006 – 7:30 p.m. at the MCRPC Offices

Mr. Scott, Chairman, called the meeting to order at 7:30 p.m. A quorum was present. Mr. Scott noted that the Minutes of the April 18, 2006 meeting were mailed prior to tonight’s meeting and there being no additions, corrections, or deletions, the Minutes stand approved as mailed.

N E W B U S I N E S S

1. Modification Request – Tammie Jordan – Coolspring Township – Mr. Gracenin explained to Committee members that were not at last months meeting the modification request to the Mercer County Subdivision and Land Development Ordinance, Article IV, Section 407(3.f.1.) requiring an access strip of 50’ in width for lands of Tammie Jordan. He stated that this modification request to the 50’ requirement was denied at the April meeting due to the access strip narrowing to less than 50 feet in width that would serve Lot 1-A and the additional acreage which could be further subdivided. Mr. Gracenin noted that discussions were held with Attorney Cardas and Attorney Kochems regarding how this situation could be alleviated. Mr. Gracenin explained that the Jordan subdivision was submitted this month as a 2 lot subdivision, Lot 1-A & 1-B. Mr. Gracenin explained that if this modification were to be granted this evening it would only be granted for Lots 1-A & 1-B. Any further subdivision of the property would require a new modification request. Mr. Gracenin explained that this would be agreeable and a workable solution between the Attorneys and MCRPC. They explained that this would allow Tammie Jordan to subdivide the existing property (Lots 1-A & 1-B) in order to receive a new mortgage on the property, which is being required by the lending agency. Attorney Cardas also stated that MCRPC should place a note on the subdivision stating that the modification was only for Lots 1-A & 1-B.

After discussion, a motion was made by Mr. Hughes to recommend approving the modification for Article IV, Section 407(3.f.1.) for Tammie Jordan for Lots 1-A & 1-B. Mr. McAdams seconded. The motion passed.

2. Modification Request – Dennis Forsyth – Pine Township – Mr. Gracenin explained that this item was withdrawn from the agenda as the modification was not needed. Apparently, a subdivision came through last year that was tied to this property in question, which has a 50’ access strip across the property. The surveyor did not show this on the current subdivision plan.

3. Map Change - City of Sharon – Mr. Gracenin explained that he received a request from the City of Sharon to change the "proposed zoning ordinance" of the old Westinghouse Parking Lot (three properties) from Residential "R-1" to Local Business District "C-2". He noted that parking lots as a primary use are not permitted in the R-1 District. During the first reading on the Ordinance, Sharon City Council and Attorney Madden realized that the back half of the property, which are parking lots, are not permitted in the Residential "R-1" District. Mr. Gracenin noted that the City of Sharon is requesting a map change to include the parking lots in the C-2 District.

In discussion, Jennifer Barborak questioned if this would be considered spot zoning. Mr. Gracenin stated no, it would be an extension of the existing zone. Ms. Barborak had concerns over the fact that these parking lots could be sold and some business could move in. After discussion, a motion was made by Mr. Hogan to recommend approval of the revised City of Sharon Zoning Ordinance. Mr. Lengel seconded. The motion passed.

There being no further business to conduct, the meeting adjourned at 8:15 p.m.
