Mr. Scott, Chairman, called the
meeting to order at 7:30 p.m. A quorum was present. A motion was made
by Dr. Brenner and seconded by Mr. McCandless to approve the Minutes of the
February 20, 2001 meeting with no additions, corrections, or deletions. The
motion passed.
N E W B U S I N E S S
1. Preliminary Subdivision Plan
Greenlee Lots 1-17 & "A" Hempfield Township
Mr. Puko reviewed this preliminary subdivision with the Committee noting
that last month we tabled the preliminary plan, but approved a modification
for Mr. Greenlee. He noted that after the modification was approved, the
surveyor took the preliminary plan and had it redrawn to match the
modification. He explained that this preliminary subdivision is off
Methodist Road with a maximum 1,200-foot cul-de-sac and would provide 17 new
lots and 1 adjoining lot Lot "A". He also stated that from
this cul-de-sac, access would be gained to two other lots via a 50
private drive, or flag lots with a 16 gravel driveway. Also from this
cul-de-sac, access would be gained to four estate-type lots via a 50
right-of-way and a 20 gravel driveway. He noted that this plan meets all
the requirements for preliminary plan through the Mercer County Subdivision
and Land Development Ordinance, but omitted calling Hempfield Township to
make sure it meets all of their requirements. He also noted that all lots
would have sewers by a public sewer collector. Ms. Heldorfer noted that we
have not received approval from DEP for the planning module. In discussion,
it was noted that the two streets off of the cul-de-sac would remain private
driveways, but it has not been determined who would actually own them. Ms.
Heldorfer stated that when the final is drawn, we would then know who would
own these private driveways so maintenance agreements would be executed.
A motion was made by Mr. Faull and
seconded by Mr. Garrett to recommend approval of this preliminary plan.
The motion passed.
2. Preliminary Subdivision Plan
Village Park Phase 4-C 4-G Pine Township
Mr. Puko reviewed this with the Committee noting that this preliminary
plan would basically finish out, in preliminary plan fashion, the Village
Park subdivision. The plan includes 70 acres and 105 lots. The development
has access to Airport Road and is not one continuous cul-de-sac. The entire
development is in an R-3 Zoning District, and would be served by Pine
Townships public sewer system and water system. Engineering data was
provided for the cross sections and profiles for streets, but the Commission
still needs to review the profiles to make sure they meet our requirements.
Mr. Puko stated that we are still waiting for the acceptability on the
capacity to connect the water and sewer facilities. Ms. Pappas stated that
yes we had received acceptability from Grove City Borough stating that they
can take the capacity from their lift station.
After some brief discussion, a motion
was made by Mr. McCandless and seconded by Mr. Garrett to recommend
approval of this preliminary subdivision plan. Dr. Brenner abstained.
The motion passed.
3. Final Subdivision Plan Village
Park Phase IV-C Pine Township This
item was tabled due to an incomplete final plan.
4. Zoning Ordinance Text Amendment
To regulate the location and other aspects of "Adult" businesses -
City of Hermitage Mr. Gracenin reviewed
the proposed text amendment to permit adult uses in the Central Commercial
zoning district. He noted that the amendment requires a 1,000-foot
separation distance between adult uses and other adult uses, schools,
churches, parks, or uses serving alcohol. Based on these measurements, there
is no location in the City where an adult use can comply and be located.
Since this has the "effect" of excluding adult uses from the City,
it exposes the City to the same legal challenge via curative amendment as if
it outright excluded such uses. In view of the need to consider a revision
to eliminate the exclusion, the Committee tabled the amendment.
5. Zoning Ordinance Text Amendment
To add "Day Care Centers" as a permitted use in the Central
Commercial and Highway Commercial Zoning Districts - City of Hermitage
Mr. Gracenin reviewed this with the Committee noting that currently
this is a permitted use in an R-3 Residential District as a special
exception and in an R-4 Residential District as a permitted use. Mr.
Jazwinski next explained that this text amendment arose from a non-profit
organization, Bradford Child Care Services out of Pittsburgh, PA, which has
29 licensed childcare centers in 4 states and they are interested in
locating in Hermitage. He noted that most of their centers are located in
either commercial or office building districts. He also noted that the
Hermitage Planning Commission approved this a couple weeks ago. Mr. Gracenin
noted that in looking at the City of Farrells Zoning Ordinance they do
allow Day Care Centers in Central Commercial Districts and are typically
found in Central Commercial Districts and Highway Commercial Zoning
Districts in other areas throughout Mercer County.
A motion was made by Mr. Garrett and
seconded by Dr. Brenner to recommend approval of adding Day Care Centers
as a permitted use in the Central Commercial and Highway Commercial Zoning
Districts. The motion passed.
