Mr. Scott, Chairman, called
the meeting to order at 6:45 p.m. A quorum was present. Mr. Scott noted
that the Minutes of the December 10, 2002 meeting were mailed prior to tonight’s
meeting and there being no additions, corrections, or deletions, the Minutes
stand approved as mailed.

Modification Request –
Maizlech – Wolf Creek Township –
Mrs. Heldorfer reviewed this with the Committee noting that the nine-lot
subdivision has seven building lots. It also has two half-acre lots that will
adjoin, one on each side, an existing lot fronting on Perrine Road. The Mercer
County Subdivision and Land Development Ordinance allows for eight or more
lots for a major subdivision. The modification request is to allow a nine-lot
subdivision to be treated as a minor subdivision.
There was discussion about the
access lanes for Lots #1, #4, and #6, and the access easement for Lot #5. Dr.
Brenner noted that there had been mining in this area but didn’t think it
was on this property.
A motion was made by Mr.
McCandless and seconded by Mr. Rollinson to recommend approval of the
modification request. The motion passed.
Liberty & Pine Township
Zoning Text Amendment – Mr. Puko
explained the amendment to the text of each zoning ordinance to accommodate a
condo-style development at the boundary of and in both townships. The
developer desires to create multi-family and single-family homes all on one
lot. Homes or apartments would be sold, but the land would be
"rented", maintained in common by a homeowners’ association. The
Zoning Ordinances do not accommodate this kind of development – they require
no more than one principal structure per lot.
The amendment would allow
multi and single family residential as planned development with more than one
principal structure on a lot. Homes would have to be developed at densities
for traditional development in the zoning district and with yards and setbacks
that would allow later subdivision into conforming lots if desired.
After brief discussion a
motion was made by Mr. Price and seconded by Mr. Garrett to recommend
approval for Pine Township. The motion was approved.
A motion was made by Mr. Price
and seconded by Mr. Garrett to recommend approval for Liberty Township.
The motion passed.

There being no further
business to conduct, the meeting adjourned at 7:00 p.m.
